The Judgment of Federal Shariat Court on Minor Christian marriage with Muslim man is condemnable. By Nazir S Bhatti
The judgement issued on Christian minor girl Maria Shahbaz with a Muslim man is violation of age set by Constitution of Islamic Republic of Pakistan as well as denial of moral, social and Human values. How a Shariat Court can pass such orders which are contrary to general laws of Pakistan. Such courts in Pakistan carry jurisdiction in Islam not Christianity. These Islamic Court are mockery to Justice system and against basic Human Rights of Christians.
I must mention here my Petition in 1992, in This federal Shariat Court to ban production and distribution of Liquor in Islamic Republic of Pakistan I argued in Petition that Islam declares Alcohol to be mother of all sins so it’s un-Islamic to collect Revenue from its business which may make whole Treasury Haram.
My Petition was heard by full Bench headed by Chief Justice Tanzeer-ur-Rehman who dismissed it on grounds that I have not filed any declaration by Muslim and Christian Religious leader.
I have given reference of my Petition to tell Federal Shariat Court Judges that why they did not call for any Declaration of any Christian Leader or Bishop in passing Judgment on Maria Shahbaz case while she was Christian. Who was Muslim scholar or attorney general of Pakistan to tell court what marriage age in Pakistan for general citizens is?
Under Child Marriage Restraint Act the age for female and male is set to be at age of 18 years old which had no objection by Religious parties like Jamiat Ulma Islam, and Jamaat Islami or any other Religious group in Parliament then why Federal Shariat Court set their own age in Maria Shahbaz case.
I think Federal Shariat Court of Pakistan Muslim judges have in their minds the marriage of their Prophet Mohammad marriage to Aisha who was minor according to Islamic history. The case of Maria Shabaz is violation committed by Judges of Federal Shariat Court on neglecting Child Marriage Act of Pakistan.
I am of opinion that Appeal may be filed against Judgement of Maria Shahbaz case in this court or Supreme Court of Pakistan to null and void this judgement.
