Ansar Burney files Petition in LHC after reports of Pakistani prisoners missing from Indian Jails

KARACHI: January 25, 2016. (PCP) The Chairman of Ansar Burney Trust International and Pakistan's former Federal Minister for human Rights, Ansar Burney, Advocate on Saturday filed a Constitutional Petition No 459/2016 in the Sindh High Court after the reports of 189 Pakistani prisoners missing from Indian Jails. Ansar Burney, Advocate said that he shocked at Pakistan Government and ‪Prime Minister Nawaz Sharif's‬ criminal silence and ignorance on painful reports relating to 189 Pakistani prisoners missing from Indian prisons, so decided to file a Constitutional petition in High Court. In his petition filed through Ansar Burney Trust, Director Shagufta Burney and Manager, Muhammad Danish Ali, it said that it is a matter of record that on 31.05.2008, a bilateral Agreement on Consular Access was executed between Pakistan and India under which both countries, exchanges a detailed list of prisoners of each country lodged in other country’s prisons twice each year i.e. on January 01 and July 01. Petition said that, in continuation and pursuance of this agreement, on 01.01.2016, both countries exchanged their respective lists of such prisoners, through diplomatic channels. That, reportedly it has transpired that a major difference/discrepancy in the Indian list is found, as Pakistani list claims 460 prisoners lodged in Indian Jails while Indian list confirms only 271 of Pakistani prisoners, meaning thereby that about 189 Pakistani prisoners are mysteriously missing from Indian Jails. Ansar Burney, Advocate in his petition said that reportedly Pakistani list claims 460 Pakistani prisoners lodged in Indian Jails (including 113 Fishermen), while the Indian authorities have only acknowledged and confirmed 271 prisoners, (including only 17 Fishermen), lodged in their jails, whereas the whereabouts of 189 prisoners is glaringly denied by India which really is a very sensitive matter. That, the Petitioner—the Ansar Burney Trust, being a human and civil rights organization has so many reservations and is very much concern and apprehensive in view of such dreadful fact as apart from humanitarian grounds, the missing Pakistanis can be misused or utilized in some terrorist activity or in some terrorism incident with the ill-motive to defame and stain the image of Pakistan in the eyes of the world at large which would harm the reputation, integrity and sovereignty of our country worldwide. That, sensing the gravity of this grave issue the Chairman of the “Ansar Burney Trust Int.” raised and took this matter with concerned authorities of Pakistan including both the Respondents and wrote letters and reminders to all of them to take an immediate and timely action upon this severe issue by taking up this matter with the Indian Government, to find out the missing Pakistani Nationals, before it’s too late. That, regretfully there has been no response, interpreting or communicating the efforts of the Government of whatsoever from any side of our Government including the important stake holder of this “agreed transaction”—the Respondents, nor this claim/fact has been refuted or denied on any forum, by them as there has been no contradictory statement to such effect has been released from any authority of Government, till the filing of this Petition. Hence this Petition. That, the Petitioner—the Ansar Burney Trust also raised its voice on this serious issue through print and electronic media, to get the attention of concerned authorities so they may take an immediate action in this specific behalf to do the needful but to no avail. (Photocopies of news showing the concerns and apprehensions of Petitioner are annexed with the Petition. That, the worries of Petitioner—the Ansar Burney Trust, regarding the safety and existence of such prisoners and the apprehensions of them being utilized in some criminal or terrorist activity to disturb the peace of both countries is mounting with every passing day and he has left with no other efficacious and alternative remedy except the knock the door of this Hon’ble Court by invoking its Constitutional Jurisdiction, which guarantees the procurement of his basic and fundamental rights, justice to all and inviolability of human dignity. Hence this Petition. That, it is worth to mention here that the Petitioner—the Ansar Burney Trust, has absolutely no sympathy or concern with the extremist, terrorist, militant elements or hardened and habitual criminals and this Petition is being filed before this Hon’ble Court, purely on humanitarian and compassionate grounds in the very interest of justice and for the sake of safety of human and civil rights, to save and preserve the fame and integrity of our beloved motherland and to ensure and promote the values of human dignity.
