New Delhi: January 15, 2016. (PCP) Addressing a press conference at Jantar Mantar, New Delhi, Headquarters of Panthers Party in exile, NPP Supremo Prof. Bhim Singh urged Shri Pranab Kumar Mukherjee, the President of India to invoke Sec.53 of the Constitution of Jammu and Kashmir and Article 174 of the Indian Constitution to dissolve the unwanted, undesirable and unacceptable Legislative Assembly of J&K so that fresh elections shall be held by September this year. This is very important and urgent and also in the interest of democracy, rule of law and delivery of justice to every electorate in the state.
Prof. Bhim Singh in a strong memorandum to the President urged him to intervene within the power vested in him by the Constitution of India and State Constitution. The President enjoys full powers and does not need opinion of the Central Govt. in this regard by virtue of Article 370 of the Indian Constitution, though it is a temporary. Prof. Bhim Singh submitted to the President that Jammu and Kashmir is integral part of Union of India and Article 370 turned infractuous after 20th August, 1952 when the state Constituent Assembly under the leadership of Sheikh Mohd. Abdullah abolished monarchy. The continuation of Article 370 is violative of fundamental rights of the people of Jammu and Kashmir who are citizens of India. The President of India should exercise his constitutional power to declare Article 370 as infructuous. Prof. Bhim Singh said that Article 370 was inserted in the Constitution of India in 1950 on the instruction/prerogative of Pt. Jawahar Lal Nehru who intended to keep console over the powers of the then ruler of J&K, Maharaja Hari Singh.
Prof. Bhim Singh, however, in his submission to the President of India strongly argued for his intervention in J&K to save J&K from further destruction and discrimination by holding fresh elections in J&K with a clear message of reorganizing the State of J&K through the establishment of a confederation of Jammu State and Kashmir Valley State with common High Court and one Governor. Prof. Bhim Singh said that the people of Ladakh should be given option to choose between Union Territory or either of the states
Prof. Bhim Singh said that people of Jammu have suffered politically and still are sufferings whereas the Kashmiris have suffered heavily at the hence of the bloody rulers import by Delhi by using handful of leaders of Jammu Pradesh.
Prof. Bhim Singh has expressed full hope in the youthful leadership of the Panthers Party which has been fighting for reorganization of J&K so that the people of Ladakh, Kashmir Valley and Jammu Pradesh shall get political, social and economic justice in all weathers.
Prof. Bhim Singh conveyed to the President of India that any attempt to forge a government of hawks and doves in Jammu and Kashmir shall prove counter-productive. He said that reorganization of Jammu and Kashmir without breaking the state is acceptable to the people of the state
