New Delhi: September 20, 2019. (PCP) “It is very sad and shocking for those who had known Jammu and Kashmir and those who know the role of the Kashmiries for centuries particularly during partition of India when they get the news about present state of affairs in Jammu and Kashmir, particularly in Kashmir. These were the people of Jammu and Kashmir particularly the Kashmiries who in once voice rejected the partition proposal of Mohd. Ali Jinnah and in 1947 the Kashmiri Muslims in one voice under the leadership of Sheikh Mohd. Abdullah and other political leaders rejected Jinnah’s offer by saying ‘no’ to Pakistan. Thousands and thousands of innocent people lost their lives in the Indian sub-continent during the partition. The minorities were the victims everywhere in the newly created Pakistan and India. It was only Kashmir province a part of the State of Jammu and Kashmir under the rule of Dogra Maharaja Hari Singh. Not a single person from minority community was touched or hurt by any person. The Muslim fraternity stood by their brethren belonging to the minority in Kashmir Valley. The basis of secularism was the great sense of humanism which spread to the whole of India from the Himalayas on the foot of which is situated Jammu and Kashmir.” This was statement made by NPP Supremo Prof.Bhim Singh who is also Sr. Executive Member of Supreme Court Association and a noted human rights activist.
Prof.Bhim Singh expressed deep shock on the situation which has developed in Jammu and Kashmir, Kashmir Valley in particular where hotels and private homes have been converted into detention centres. Where more than 3000 people have been detained under the outdated/expired Law drawn from Public Safety Act, 1978 where hundreds of noted religious scholars have been detained in their houses like Mirwais Farooq, where ex-legislators and ministers have been locked under Public Safety Act or under so-called personal bonds, where the religious leaders are forced to sign personal bonds that they shall not talk politics or shall not enter political activities. Even the former Chief Minister like Dr. Farooq Abdullah and Ms. Mehbooba Mufti stand detained for how long? No one knows about the future of the political activists and others who have been detained without any legal cause or rule.
Article 21 of the Constitution of India which was applicable to Jammu and Kashmir even when Article 35-A was alive has been buried into the graveyard of the President’s Rule. There is no government/no governance/and no rule of law where the fundamental rights enshrined in Chapter-III of Indian Constitution have gone with the wind and there is not to reason why. It was shocking to read from some of the national newspaper that several persons/leaders/present and ex-legislators have been detained under Section 107 of the Code of Criminal Procedure Code and the politicians who signed the bonds and give an undertaking that they would not indulge in any political activities after their release. What a horrible state of affairs. Where are the fundamental rights, where is the freedom or freedoms which have been granted to the residents of J&K also and have become eternal after the removal of Article 35-A from the Constitution. There is no Law in the country and such law was not practiced/used by the British rulers against the freedom fighters even. Such a horrifying Law was not used in the history by Nazi government under Hitler against the Jews fighting for human rights in Germany during the World War-II.
Prime Minister’s slogan sounds empty when he says, ‘hug each Kashmiri, build new paradise in Kashmir’. NPP Supremo urged the regional political parties in India as well as all the national political parties and the Members of the Parliament to come forward as human being as a brick of the edifice of India to ensure that fundamental rights enshrined in Chapter-III of Indian Constitution which is applicable today, should apply to the residents of J&K irrespective of their region, religion or political philosophy they are associated with.
NPP Supremo also urged the President of India to convene an urgent meeting of the representatives of all recognized political parties of J&K and ensure that they are released from their respective detention centres and attend the meeting. The leadership of National Conference, PDP and J&K National Panthers Party besides representatives of national political parties operating in J&K may also be invited to attend the meeting. He called that jails, bullets, slogans and state terrorism shall not return peace in J&K. All the leaders of all political parties and the ex and present legislators should be set free without any delay. He urged the President to use his constitutional authority which he enjoys today as J&K is under President’s Rule. He assured that the President shall get full.
