Reserved Minority Parliamentary Seats or Lottery System in Pakistan. By Dr. Emanuel Adil Ghouri
While hearing a case in the Supreme Court on the petition of the Sunni Ittehad Council regarding the unfair distribution of reserved seats, a respected judge remarked whether reserved seats are a lottery system. Whether he asked this as a question or as a joke is a separate debate, but the fact is that politically, the status of these seats is exactly like a lottery system. The worthlessness and the monkey business of these seats in 2024 have exposed their importance. After the political problems of the PTI arose, when it joined the Sunni Ittehad Council, it was necessary for the PTI to consult with its minority wing regarding minority seats. However, by joining the Sunni Ittehad without taking the minority wing into confidence, it proved how important minorities are to the PTI.The manifesto of the Sunni Ittehad Council is clear that no non-Muslim can be its member, so it has no connection to specific seats. While reviewing this situation, Chief Justice Qazi Faez Esa, while addressing Sunni Ittehad Council lawyer Faisal Siddiqui, said, "Look at the flag of Pakistan, it has white color. Doesn't it include the rights of minorities?" Also see the statement of Quaid-e-Azam Muhammad Ali Jinnah that the rights of minorities are equal. You have abolished the rights of minorities in your constitution. Your party's constitution is not a violation of the constitution of Pakistan.Now the minority seats that it does not get will be distributed among other parties, so where will the democratic rights of minorities who do not like other parties go? PTI lawyer Babar Hussain Bharwana, while giving arguments, said how this democratic right of minorities has been killed. These seats should be left vacant until Article 51 or 106 of the Constitution is amended by the Parliament.
It seems that if this case is not decided for five years, the minorities affiliated with this party will remain deprived of representation in parliament. This undemocratic behavior of the said person was a source of surprise even for the judiciary. The entire parliament is formed democratically. Unfortunately, nominations for minority seats are made undemocratically. The opinions of the classes for whom these seats are reserved are not even taken into consideration. For example, there are 60 seats reserved for women in the National Assembly, and the women nominated to these seats have no political background, except that they are the daughter-in-law, daughter, sister, or wife of an MNA or a party leader. These women, who have won seats in the name of women, have no connection with housewives, nor have they ever raised their voices against the atrocities committed against women. Here, women are stripped naked and tortured in police stations, paraded on the streets, women who marry of their choice are put to death, honor killings are part of the tradition, sexual harassment at workplaces and women workers working in kilns who live a life of slavery have never been discussed in Parliament. 55% of the population in Pakistan is women, in whose name these women sitting in parliament are unaware of their problems and come here for entertainment, considering it a job. The same is true of the selected representatives nominated to minority seats, who have no connection whatsoever with solving the nation's problems. Everyone's struggle is limited to pleasing their political patrons. They are only concerned and interested in their own seats. There are many problems of minorities that need to be solved, which they have never paid attention .For example, minorities are deeply concerned about the misuse of discriminatory laws. The number of minority seats in parliament could not be increased due to the lack of an accurate census. No bill has ever been introduced for direct elections to minority seats. Regarding the selected representatives, Justice Jamal Khan Mandwakhel asked why reserved seats should be given to those who did not even bother to contest the elections. During the hearing of this case, the judges and lawyers also raised various questions regarding the specific sessions and pointed out many flaws in the procedure. How wonderful it would be if, keeping all these things in mind, the court, in order to liberate minorities from political slavery, issued a directive to the current parliament to adopt the method of electing representatives through direct elections instead of selection for the aforementioned seats.
