LHC reserves verdict on Christian Divorce Act case

Lahore: January 21, 2017. (PCP) Lahore High Court have reserved judgement on Christian Divorce Act of 1869 case again after Christian clergy filed review in a case filed in 2016 to makes changes in law. The Federal Minister for Human Rights who is Christian Senator Kamran Michael and The Punjab Minister Tahir Khalil Sandhu along with five Bishops of different Churches in Pakistan appeared in hearing submitting plea that there is no permission of Divorce according to teachings of Holy Bible. Former Member of National Assembly of Pakistan Emmanuel Zafar Advocate wrote books of Christian Marriage and Divorce but none was referred in this case unless there is no legal view in accordance with constitution of Islamic Republic of Pakistan except these two legal books. The social evil has taken over Christian life in Pakistan and trend to keep two wives among Christian men is at rise. There is section of clergy in Pakistan who allow and solemnize second marriage after taken heavy donations. There is sizeable number of Christian men who convert to Islam to break up their Christian marriage and enter in marriage with other woman. The Major Church in Pakistan like Catholic Church of Pakistan is silent on this issue and Bishops Conference of Catholic Church of Pakistan has not issued any decree on this issue yet. Federal Minister for Human Rights Senator Kamran Michael on Friday told the Lahore High Court that divine laws could not be changed in the name of fundamental rights. The chief justice observed that the court was not supposed to interpret Bible or the Old Testament but to implement the Constitution, which says “Right to practice religion is available to every citizen based on his conscience.” Earlier, petitioner’s counsel Sheraz Zaka argued that section 10 of Divorce Act 1869, provided only one ground to a man to divorce his wife and that is imputing the charge of adultery as well as to prove it. He said the ground for the dissolution of marriage was against the dignity of a woman. The lawyer said in Christian majority countries, the law had been amended and there were other logical grounds available for a Christian couple to seek separation. After hearing the opinion of the Christian representatives, the chief justice reserved verdict in the case.
