Professor Anjum Paul writes Chief Justice of SCP on Constitutional Rights of Non-Muslim Students

Faisalabad: April 16, 2016. (PCP) In a letter to Justice Anwar Zaheer Jamali, Chief Justice Supreme Court of Pakistan Ref. No. PMTA/22-26/16-KPR, dated April 11, 2016, Professor Anjum James Paul Chairman, Pakistan Minorities Teachers’ Association (PMTA) has requested on Constitutional Rights of Non-Muslim Students. Professor Anjum James Paul, Chairman PMTA expresses in the letter, “Pakistan Minorities Teachers’ Association (PMTA) has already mailed you a letter Ref. No. PMTA/59-71/15, dated November 16, 2015, subject “Request to Save Beliefs and Religious Freedom of Non-Muslim Students and Teachers” along with a document ‘Pakistani Textbooks a Threat to the Lives and Beliefs of Non-Muslims’ and a documentary with a title ‘Pakistani Textbooks a Question Mark for Non-Muslims’ to honorable Justice Anwar Zaheer Jamali, Chief Justice Supreme Court of Pakistan.” Following references of the Articles of the Constitution of Pakistan 1973 have been mentioned which guarantee fundamental human rights to all citizens without any discrimination. “Article 20 (a) guarantees, “Every citizen shall have the right to profess, practice and propagate his religion.” Article 22 (1) guarantees, “No person attending any educational institution shall be required to receive religious instruction, or take part in any religious ceremony, or attend religious worship, if such instruction, ceremony or worship relates to a religion other than his own.” Article 25 (1) guarantees, “All citizens are equal before law and are entitled to equal protection of law.” Article 36 guarantees, “The State shall safeguard the legitimate rights and interests of minorities, including their due representation in the Federal and Provincial services.” In the letter Chairman PMTA says, “It is a sorrowful state that the Federal and Provincial Textbook Boards of Pakistan are openly violating Article 20 (a), Article 22 (1), Article 25 (1) and Article 36 of the Constitution of Pakistan for decades. Pakistani educational system also violates Article 26 (2 & 3) of the United Nations Universal Declaration of Human Rights, Article 2 (2) and Article 14 (1) of International Convention on the Rights of the Child, Article 18 (2 & 4) of International Covenant on Civil and Political Rights, Article 5 (2) of Declaration On The Elimination Of All Forms Of Intolerance And Of Discrimination Based On Religion Or Belief, UNESCO and June 19, 2014 Verdict of Supreme Court of Pakistan regarding protection of minorities rights.” Professor Paul says in the letter “The Federal and Provincial governments have failed to safeguard the fundamental and constitutional rights of the suppressed non-Muslim students regarding their religious beliefs and practices. Non-Muslim students are losing their religious identity due to the Islamization of education. Education policy, curriculum, textbooks and the environment of educational institutions consider all students as Muslims, injuring the religious sentiments of non-Muslim students. They are forced to study Islamic beliefs and practices in all the compulsory subjects of languages, social sciences and pure sciences. Non-Muslim students have to study the subject of Islamic Studies (compulsory) from grade 3 to grade 10 because no arrangements of textbooks and teachers have been made for the religious education of non-Muslim students. Not only public educational institutions but also the educational institutions run by non-Muslims have become Islamic seminaries because most of the subjects and textbooks have been Islamized. The lives of non-Muslim teachers and students are always at risk because they are the soft target. Pakistani non-Muslim students are facing the same problems and threats regarding their religious identity and religious freedom which Muslim minority students faced during Congress rule in the undivided India in 1930s when Wardha Scheme was introduced.” In the letter there has been an analysis of the textbooks regarding Islamization of textbooks and he says more in the letter, “A picture of religious persecution and discrimination is presented in the following tables. Punjab Curriculum And Textbook Board Lahore (PCTB) has published textbooks for 2016-2017. Pakistan Minorities Teachers’ Association has research on 51 textbooks in twelve various subjects of languages, social sciences, pure sciences and Islamic Studies published by PCTB in 2016 from grade 1 to grade 10. Out of 51 textbooks, 38 textbooks have been Islamized. Thus there is 74.50 percent Islamization of textbooks. There is confusion in the textbook of History 8 because on one side ‘Role of Non-Muslims in the Pakistan Establishment’ is part of the present textbook and the matter on the said content was mailed to PCTB on her request by Professor Anjum James Paul, Chairman PMTA but on the other side there are biases against Christians, Hindus, Sikhs and British on religious basis. (Note: History 8 is not included in 51 textbooks but is a separate one). Subject wise Islamization of textbooks in the compulsory subjects of Languages. 1. Arabic, grade 6-8, out of 80 units 55 units have been Islamized, so there is 68.75 percent Islamization of textbooks. 2. Urdu, grade 1-10, out of 227 units 70 units have been Islamized, so there is 30.83 percent Islamization of textbooks. 3. English, grade 4-10, out of 91 units 13 units have been Islamized, so there is 14.28 percent Islamization of textbooks. Subject wise Islamization of textbooks in the compulsory subjects of Social Sciences. 1. General Knowledge, grade 1-3, out of 61 units 15 units have been Islamized, so there is 24.59 percent Islamization of textbooks. 2. Social Studies, grade 4-5, out of 14 units 3 units have been Islamized, so there is 21.42 percent Islamization of textbooks. 3. History, grade 6-7, out of 10 units 8 units have been Islamized, so there is 80.00 percent Islamization of textbooks. 4. Geography, grade 6 & 8, out of 18 units 2 units have been Islamized so there is 11.11 percent Islamization of textbooks. 5. Pakistan Studies, grade 10, out of 4 units 2 units have been Islamized, so there is 50.00 percent Islamization of textbook. Textbooks of Islamic Studies (compulsory). Islamic Studies, grade 3-8, out of 30 units 30 units have been Islamized, so there is 100.00 percent Islamization of textbooks. Subject wise Islamization of textbooks in the subjects of Pure Sciences. 1. Biology, grade 9 out of 9 units 1 unit has been Islamized, so there is 11.11 percent Islamization of textbook. 2. Physics, grade 9 out of 9 units 1 unit has been Islamized, so there is 11.11 percent Islamization of textbook. Islamization of textbooks in the compulsory subjects of Languages, Social Sciences, Pure Sciences and Islamic Studies. 1. Languages, grade 1-10, out of 398 units 138 units have been Islamized, so there is 34.67 percent Islamization of education in the textbooks. 2. Social Sciences, grade 1-10, out of 107 units 30 units have been Islamized, so there is 28.03 percent Islamization of education in the textbooks. 3. Islamic Studies, grade 3-8, out of 30 units 30 units have been Islamized, so there is 100.00 percent Islamization of education in the textbooks. 4. Pure Sciences, grade 9, out of 18 units 2 units have been Islamized, so there is 11.11 percent Islamization of education in the textbooks. Over all Islamization of education in the textbooks. Out of 553 units 200 units have been Islamized, so there is 36.16 percent Islamization of education in the subjects of languages, social sciences, Islamic Studies and pure sciences. Unbiased textbooks published by PCTB in 2016. 1. English, grade 1-3 2. Mathematics, grade 1-5 3. General Science, grade 4-5 4. Geography, grade 7 5. Chemistry, grade 9 6. Physics, grade 10” In the end Professor Paul says, “It is a humble request to you to order the concerned quarters to address the genuine grievances of the non-Muslim students to avoid the violation of the Constitution of Pakistan. It is also requested you to kindly order the Punjab government to produce Sana Shahid, a 13 years minor Christian girl of grade 5 who has been abducted, forcibly converted and forcibly married to Waheed Akhter S/O Muhammad Bashir, resident of Mohallah Kasayian, Rodes Road, Mianapura, Sialkot in the jurisdiction of Hajipura Police Station Sialkot on November 9, 2015 violating the Child Marriage Restraint (Amendment) Act 2015. PMTA has already wrote a letter and brought the case in your good self with documentary evidence on November 16, 2015. It is April 9, 2016 today and 153 days have passed since she was stolen from her family and is in the captivity of the accused. The local police has not arrested the accused who has openly violated the land law though FIR No.933/15 was logged in the Hajipura Police Station Sialkot on the day of her abduction. Sana Shahid’s return to her family can be a ray of hope for all the non-Muslim parents whose beloved daughters are stolen from them because they are considered fragile being less in numbers on the basis of religion. Sana Shahid’s daddy is still waiting for his beloved daughter, saying, “When will our daughter be returned to us”. Prime Minister’s National Enrolment Scheme 2016 to send every child to school is a question mark when Sana’s education has been forcibly stopped and her sister Hina and younger brothers have left school in fear of abduction, forced conversion and forced marriage.” Note: Copies of the letter have been mailed to Mr. Mamnoon Hussain, President of Pakistan, President’s House, Islamabad, Mr. Muhammad Nawaz Sharif, Prime Minister of Pakistan, Prime Minister’s Secretariat, Islamabad, Mr. Sardar Muhammad Yousaf, Federal Minister for Interfaith Harmony, Islamabad and Mr. Abdul Sattar, Director, National Commission of Human Rights, Government of Pakistan, Islamabad.
