The uproar in political arena of Pakistan caused by Supreme Court of Pakistan verdict to indict Prime minister of Pakistan under contempt of court charges have created serious concerns among circles interested in supremacy of parliament. No doubt, judiciary is an important pillar of democracy but when it threats to an elected institution like parliament then question arises who will Judge these Judges? The President of Pakistan reserves right to impeach any Justice of supreme Court of Pakistan in accordance with Article 209, Section 5 and 6(B) but in prevailing situation it requires urgent amendment that parliament may impeach any Justice or Chief justice of Pakistan with two third majority vote that higher courts may not cross their limits to undermine democratic system in Pakistan. The people of Pakistan who were annoyed of corrupt political and judicial system in Pakistan, sacrificed lives for restoration of Iftikhar Mohammad Chaudhry, Chief Justice of supreme Court of Pakistan when he defied illegal orders of General Parvez Musharraf to sack him from office. Justice Iftikhar Mohammad Chaudhry emerged as dream Justice for oppressed communities who thought he will block way of General’s rule in Pakistan who tooled judiciary to legitimate military rule. It was also visualized by Pakistani Civil society that rule of law and justice shall prevail if Justice Iftikhar Mohammad Chaudhry is restored but nothing changed. The recent moves of Supreme Court of Pakistan have proved that expectations of common Pakistani are betrayed when cases of missing persons which are blamed on ISI are waiting to be heard but issues against a particular political group are preferred. Yousaf Raza Gilani, Prime Minister of Pakistan, restored Iftikhar Mohammad Chaudhry as Chief Justice of Supreme Court of Pakistan on March 16, 2009, after long marches of lawyer fraternity and civil society activists to prove that Pakistan People’s Party PPP respects judiciary as an important pillar of democracy but was there any hidden hand behind it? But, I questioned at that time also, that how you can restore a Chief Justice who have been leading public rallies like a politician and moreover have taken oath under PCO? I raised voice when USA was awarding Chief Justice Iftikhar Mohammad Chaudhry title of “Lawyer of the Year” because he never deserved it. It is ironic to note that Chief Justice of Supreme Court of Pakistan who campaigned against Judges who took oath under PCO to regain his job forgot that he also took oath under PCO in 2000, as Judge in Balochisan High Court. After restoration of Chief Justice of Supreme Court of Pakistan in 2009, it was assumed by People of Pakistan that rule of law shall be also restored and safety of life and property shall be ensured but it amazed them that guns of Judges of Supreme Court of Pakistan were not on targets which were causing line of missing persons and laws violating basic equal human rights of religious communities. The Christians were gunned down in broad day light in court houses, Muslim mobs attacked Christian life and property and Christian women, elders and children were burnt alive by Muslim mob but Chief Justice remained silent. There were extra-judicial killing of innocent Baloch youth in Balochistan but Chief Justice of Supreme Court of Pakistan never held proceeding in Quetta but preferred to take notice of Sindh, especially Karachi City, neglecting Punjab where Christian Properties and Churches were vandalized and Ahmadi worshipers in mosques were gunned down. Who can call such a Supreme Court as an independent and irrational? Now, let’s watch this list of Judges who have taken oath under PCO but Iftikhar Mohamma Chaudhry never raised objection on them: First, I must point out one Justice of Supreme Court of Pakistan to whom Chief Justice insisted to keep as ad-hock Judge after his retirement age: He is Justice Mr. Justice Khalil-ur-Rehman Ramday who took Oath on PCO as Judge of Lahore High Court on January 26, 2000, and I saw him on Geo TV on Kamran Khan Show, who was reading judgment on NRO case, without remembering that he cannot enter in any political venue before two years of his retirement date but honorable Chief Justice of supreme Court of Pakistan not noticed him in contempt of court. Why Chief Justice of Supreme Court of Pakistan not took Suo-Motto notice on killing of Baloch and Christians in Pakistan? The secret was revealed in press after his restoration that his restoration was due to General Kiyani, Chief of Pakistan army not Prime Minister Yousaf Raza Gilani only. When ISI is behind killing of Christian federal minority minister Shahbaz Bhatti and Baloch youth, so, how he can move against Pakistan Army to check their atrocities. See names of Judges who took oath under PCO but Iftikhar Mohammad Chaudhry had no objection on them to induct in his bench because he by himself was PCO Judged; Took Oath on PCO as Chief Justice Balochistan High Court on January 26, 2000, Mr. Justice Javed Iqbal, took Oath on PCO as Judge of Balochistan High Court on January 26, 2000, Mr. Justice Sardar Muhammad Raza Khan, took Oath on PCO as Judge of Peshawar High Court on January 26, 2000, Mr. Justice Khalil-ur-Rehman Ramday, took Oath on PCO as Judge of Lahore High Court on January 26, 2000, Mr. Justice Mian Shakirullah Jan, took Oath on PCO as Judge of Peshawar High Court on January 26, 2000, Mr. Justice Tassaduq Hussain Jillani, took Oath on PCO as Judge of Lahore High Court on January 26, 2000, Mr. Justice Nasir-ul-Mulk, took Oath on PCO as Judge of Peshawar High Court on January 26, 2000, Mr. Justice Raja Fayyaz Ahmed, took Oath on PCO as Judge of Balochistan High Court on January 26, 2000, Mr. Justice Ch. Ijaz Ahmed, took Oath on PCO as Judge of Lahore High Court on January 26, 2000, Mr. Justice Ghulam Rabbani, took Oath on PCO as Judge of Sindh High Court on January 26, 2000, Mr. Justice Sarmad Jalal Osmany, took Oath on PCO as Judge of Sindh High Court on January 26, 2000, Mr. Justice Muhammad Sair Ali Khattak, Appointed as a Judge of the Lahore High Court Lahore on 2 May 2001, Mr. Justice Mahmood Akhtar Shahid Siddiqui, Appointed as a Judge of the Lahore High Court Lahore on 21 September 2001 and Mr. Justice Jawwad S. Khawaja, took Oath on PCO as Judge of Lahore High Court on January 26, 2000. All these Judges issued verdict against PCO but exempted themselves from PCO appointments: Do you take it as fair? Big No... It’s only answer: Who can admit that PCO oaths of our honorable Judges in January 26, 2000, were exceptional cases to be totally ignored? Can there be any different judgment on a murder in 2009 than a murder in 2000? The Pakistan People’s Party PPP can gain political ground after conviction of Prime Minister Yousaf Raza Gilani as political martyr but it is not solution to manage pillars of democracy in limits which is very important for soverginity and integrity of Pakistan. If we want democratic Pakistan then we must have to make Pakistan army, judiciary and other public service officials accountable under parliament of Pakistan.
