Bhopal, India: July 7, 2011. (PCP) The Madhya Pradesh High Court served a notice on the state government on Wednesday seeking its reply on the alleged misuse of Right To Education (RTE) Act in implementation in minority- run education institutions in the state. The court order came in response to a writ petition filed by Catholic Council of Bishops of Madhya Pradesh through its spokesperson Father Anand Muttungal. The petition has challenged gazette notification issued by the state government for implementation of the RTE in the state. The state government order, he said, undermined the rights guaranteed to the minority institutions and allowing government officials to begin to meddle in with the administration of the minority schools. They also issued illegal orders for admission with direction for compliance report and also interfered with the day to day administration in schools. He contended that this interference only was violation of the constitutional safeguards to minority educational institutions guaranteed under Articles 29 and 30 but also affected quality education the institutions are providing. The petition has also included direction issued by the Central government to state government reminding it that the RTE Act was made keeping in view of the constitutional safeguards guaranteed to the minorities. Even after these clarifications from the Central government, the state government officials continued to use the RTE as a means to harass minority run education institution, he alleged in the petition. Advocate James Antony appeared for the petitioner. The bench of Chief Justice Rafat Alam and Justice Alok Aradhe posted matter for next hearing after a month.
