J Salik files petition in SC to block midterm elections without minorities direct elections.

Islamabad: February 26, 2011. (PCP) J Salik, Ex-MNA from all Pakistan constituency for Christian reserve seats and Ex-Minister for Population Welfare Government of Pakistan have filed a constitutional petition in Supreme Court of Pakistan here today. He have submitted that the petitioner is very much concerned with the betterment and affairs of the minorities in Pakistan. This is the reason that’s why the petitioner invoked the constitutional jurisdiction of Supreme Court of Pakistan challenging article 51(6)(e) of the constitution of Pakistan which says a under “ Members to the seats reserved for non-Muslims shall be elected in accordance with law through proportional representation system of political parties list of candidates on the basic of total number of general seats won by each political party in the National Assembly.. provided that for the purpose of this paragraph the total number of general seats won by a political party shall include the independent returned candidate or candidates who may duly join such political party within three days of the publication in the official Gazzettee of the names of the returned candidates” According to the petitioner, this clause of the constitution of Pakistan, deprive the minorities to choose their representatives through ballet / elections. Petition states that above cited constitution petition along with other petitions regarding 18th Amendment was fixed before this Apex Court and after some interim orders, it was adjourned, it is pertinent to mention here that regarding the issue of minorities no order was passed which could provide protection to the minorities during the pendency of the above mentioned constitution petitions. Presenting situation of country it is cited that in result of latest non-Cooperation News in between the ruling party and a prominent political party ie P.M.L (N) and critical law and order situation which shows total failure of system to provide protection to the life and safety of people and to provide them social justice , even the worst down going economical situation which is mainly result of lack of suitable and impartial required decisions on the part of Government and also result of its total failure to provide required basic need of industries in shape of electricity and gas, circumstances are leading toward such direction in which situation could go to such extent where decision regarding mid term election can be taken. It is feared that in case of MIDTERM ELECTION without consideration of the petitioner’s constitution petition there will be every apprehension for the minorities to once again face the same circumstances under which they have been deprived of their basic right of chosen representation because in view of fundamental right articles of the constitution of Pakistan 1973 , the petitioner believes to succeed his above titled case / constitution petition. J Salik have prayed that interim relief may be granted to the petitioner by issuing direction to the respondent not to announce and conduct any Midterm Elections or Elections for National Assembly and Provincial Assemblies till the disposal of the main constitution petition. Mr. Zulfiqar Ahmed Bhutta Advocate and Mr. Ejaz Muhammad Khan Advocate have presented this constitutional petition on behalf of J Salik in Supreme Court of Pakistan.
