Union Government must enact law to avoid future Ayodhyas. By Fr. Anand Muttungal

It may not be exaggerating to say that after the event of independence of India , the Ayodhya verdict would be the most remembered historical event by all Indians. It is the dawn of a matured nation. It is the history of a Nation that withstood all odds of violence and bloodshed. The whole nation feels proud of being an India at this juncture. It was a rare exhibition of respectful and dignified concern to followers of every religion. The media, religious leaders, almost all political leaders, leaders of socio-religious organizations and administration showed an exceptional will to maintain peace. A section of legal experts including the retired judges, social activists and political leaders have questioned the legal provisions used in the verdict to provide all inclusive judgement. Some legal experts see a judicial statesmanship in the verdict. The verdict reflected the aspirations of majority and minority communities. It is very difficult to claim victory of any one party. The disputed site can be a historical symbol of communal harmony with worship places of both communities in the disputed site. If the judgement is not implemented with sufficient dialogue between Hindus and Muslims, it can also be a permanent place of communal tension in the days to come. In the judicial process previous judgements of a higher court is referred in all similar cases. For instance the order of the Supreme Court is referred in all the courts in the Country. It is also seen that in some cases the High Court judgements are referred in the Supreme Court. So if the Allahabad High Court has used a legally incorrect method of statesmanship to settle the most awaited judgement on the Ayodhya, will it not become a referral point to settle cases of such nature? The fundamental organizations in the past have raised such disputes with many other worship places too. So a natural question is, will this judgement pave way for many more disputes in the days to come? If this matter reaches the Supreme Court then the Court will have to specify that the verdict is applicable to that particular case only and it should not be seen as precedents to law suits. In case the dispute does not reach the Highest Court of Law then the law makers of this country who are vested with special duties and privileges must act. They have a greater responsibility now to protect the interest of all communities and their worship places. The Union Government must enact a law to maintain status quo of all religious places built before independence of this country. It is not only in India but all around the world kings when took over the reign of a country that they conquered, they converted the famous religious places into the worship places of their favourite deity. It was considered the befitting thanks giving to the particular deity and capturing the wealth in the worship place rather than humiliating the defeated king and his people. If we start digging the ancient histories with the help of Archaeological Survey of India, can this Nation move towards progress? As we showed exceptional will to maintain peace in such occasion, we must say in one voice, no more disputes over any worship place, let our law makers enact a law to put an end to all future Ayodhyas.
